Terms & Conditions for Credit Application

Important Notice
This document applies only to the credit application process and is not a loan agreement. Submission of an application does not guarantee approval, funding, or specific loan terms. Additional terms and conditions will apply if financing is approved.
Application Scope
These Terms govern only the submission and processing of a credit application. They do not create any obligation to lend or borrow, and they do not constitute a binding loan commitment by Fast Finance LLC.
These Terms & Conditions apply to all applicants submitting a commercial financing application to Fast Finance LLC, a Florida limited liability company, doing business as FastFinance Capital Group ("Fast Finance," "Lender," or "Company"). By submitting an application, you agree to be bound by the following terms.

1. Business Purpose Certification
- Applicant certifies that all financing requested is strictly for business or commercial purposes and is not intended for personal, family, or household use.
- Fast Finance is not a consumer lender and does not engage in personal, family, or household loans.
- All disclosures, pricing, and underwriting are based on commercial loan structures.
- Any misrepresentation of the loan's purpose constitutes material fraud and may result in denial, termination, and civil action.
2. Accuracy of Information
- Applicant affirms that all information submitted — including identity documents, business documents, insurance, income, bank statements, and vehicle information — is true, complete, accurate, and not misleading.
- Submitting falsified or manipulated documents is fraud.
- Fast Finance may verify all documents with third-party systems.
- Errors, omissions, or inconsistencies may delay or terminate the application.
- Fast Finance may deny an application for any lawful reason.
3. Required Documentation
Applicant agrees to provide all documents required during underwriting, including but not limited to:
- Valid driver license or CDL
- Social Security or EIN verification
- Business documents (Articles, active state registration, EIN letter)
- Proof of business address and operations
- Commercial insurance declaration pages
- Vehicle photos, VIN, mileage, and title documents
- Bank statements (personal and/or business)
- Proof of down payment source
- Purchase agreements, invoices, and seller contact information
Failure to submit required documents may result in denial, delay, or application closure. Fast Finance may require updated documents at any time.
4. No Guaranteed Approval
Submitting an application does not create any obligation to approve, fund, or offer specific terms. Fast Finance may:
- Request additional documents
- Increase down payment requirements
- Change terms based on underwriting
- Decline any application at its sole discretion
All decisions are final and based on internal underwriting rules.
5. Identity Verification, Fraud Screening & Background Checks
Applicant authorizes Fast Finance to conduct:
- Identity verification (driver license, SSN, EIN)
- Business verification with state agencies
- OFAC / watchlist screening
- Fraud detection and public records review
- Down-payment source verification
- Criminal background checks (as permitted by law)
Fraud activity may be referred to law enforcement. Third-party tools may include LexisNexis, Microbilt, Experian Business, and fraud-prevention databases.
6. Vehicle Inspection & Appraisal
Fast Finance may require:
- Physical and mechanical inspection
- Frame/engine inspection and diagnostic test
- Professional valuation or appraisal
- Seller verification
Funding will not be released until inspection is completed. Applicant is responsible for inspection fees unless otherwise agreed in writing.
7. Insurance Requirements
If approved, Borrower must maintain continuous commercial vehicle insurance listing Fast Finance LLC as Primary Lienholder, Primary Loss Payee, and Additional Insured. Coverage must include:
- Commercial auto liability
- Comprehensive and collision
- Physical damage coverage equal to the vehicle's market value
- No deductible above $2,500 unless approved by Fast Finance
- No lapse in coverage permitted
In the event financing is approved and a loan agreement is executed, insurance requirements and consequences of non-compliance will be governed by the final loan agreement.
8. Electronic Signature & Records Consent
- Applicant consents to electronic signatures, electronic records, and electronic delivery of disclosures.
- Electronic signatures carry the same legal weight as original wet signatures.
- Applicant agrees that all documents may be stored electronically.
9. Communication Consent
Applicant consents to be contacted through:
- SMS/text messages
- Phone calls and voicemail
- Secure links and web portals
- Automated or prerecorded messages
Transactional communications related to the application or account cannot be fully opted out of.
10. Credit Authorization
Applicant authorizes Fast Finance to:
- Pull personal and business credit
- Perform multiple inquiries during underwriting and prior to funding
- Use soft or hard inquiries
- Verify identity with credit bureaus
Applicant acknowledges FCRA rights, including the right to request reasons for denial and the right to dispute inaccurate credit information.
11. Bank Account & Funds Verification
Applicant authorizes Fast Finance to verify:
- Bank balances, deposits, and income
- Down-payment sources
- NSF history
- Identity information linked to bank accounts
Verification tools may include Plaid, micro-deposits, bank verification APIs, or manual bank officer verification.
12. Seller / Dealer Verification
Applicant authorizes Fast Finance to contact the seller to verify:
- VIN, title status, and outstanding liens
- Mileage, frame/engine condition, and odometer disclosures
- Vehicle accidents or repairs
- Sales price and seller identity
Fast Finance may require the seller to submit documents directly.
13. Fraud, Misrepresentation & Criminal Activity
Fraud includes but is not limited to:
- Altered identification or documents
- Fake insurance, bank statements, or business information
- Concealing the location of collateral
- Attempting to defraud the seller or lender
Consequences may include denial, application cancellation, reporting to credit bureaus, and referral to law enforcement.
14. Privacy, Data Use & Security
- Fast Finance uses encryption, secure cloud storage, access-restricted databases, and fraud-detection tools.
- Fast Finance complies with the Florida Information Protection Act (FIPA) and the Gramm-Leach-Bliley Act (GLBA).
- Fast Finance does not sell customer data.
15. Data Sharing Disclosure
Applicant authorizes Fast Finance to share data only as necessary with:
- Insurance companies, DMVs, and credit bureaus
- Repossession agents and collections agencies (if applicable under a final loan agreement)
- Sellers, attorneys, and accountants
- CRM systems and fraud-prevention databases
16. Right to Update Personal Information
Applicant may request corrections or updates by emailing Fastfinance1@fastfinanceinvest.com.
17. Consumer Rights (Florida — FDBOR + FIPA)
Applicant may request:
- Copies of personal data
- Corrections or updates
- Deletion (where legally permitted)
- Disclosure of data-sharing practices
18. Third-Party Tools & Links Notice
- Fast Finance uses external tools including Google Analytics, Google Drive, payment processors, and e-Signature platforms.
- These services have their own independent privacy policies.
19. Prohibition of Minors
Applicants must be 18 years of age or older.
20. Application Withdrawal & Abandonment
Applications may be closed if:
- Documents are not submitted within 10 business days
- Applicant is unresponsive
- Fraud is detected
- Required items remain outstanding
21. No Verbal Agreements
Only written agreements signed by Fast Finance LLC are binding. No verbal representations create legal obligations.
22. Portal Conduct Rules
Applicant agrees not to:
- Share login credentials
- Upload malicious files
- Submit fraudulent documents
- Harass staff or contractors
Fast Finance may terminate portal access at any time without notice.
23. Loan Agreement Terms (If Approved)
In the event financing is approved and a loan agreement is executed, additional terms regarding default, collections, repossession, and enforcement will be governed exclusively by the final signed loan agreement.
This application-level document does not constitute or replace any final loan agreement.
24. Arbitration — Pinellas County, FL
- Applicant agrees that all disputes shall be resolved by binding arbitration conducted in Pinellas County, Florida.
- Applicant waives jury trial and class action rights.
- Fast Finance may seek repossession, lien enforcement, or emergency injunctive relief directly in court without arbitration.
25. Governing Law & Venue
These Terms are governed by the laws of the State of Florida.
Non-arbitrable matters shall be heard exclusively in Pinellas County, Florida.
26. Acceptance & Binding Acknowledgment
By submitting an application, Applicant acknowledges and agrees to all Terms and Conditions, all authorizations, and all privacy and credit disclosures set forth herein.
Submission of an application constitutes legal acceptance of these Terms.
